The vaping industry may be in real trouble due to the most recent FDA vaping regulations that go into effect today. It has been almost a decade since electronic cigarettes hit the market. In the last five years, vaping has become a rapidly trending culture in several regions of the world.

Vape stores and ice cream shops have had one thing in common for years now: free samples. Just like an ice cream shop lets you try a spoonful of any flavor before choosing your double scoop, vape shops often let customers sample e-liquid flavors before buying a full bottle. But those days have officially ended in the US, as the Food and Drug Administration’s regulations on e-cigarettes came into effect Monday.

Monday, August 8th, 2016 marks the start of a two-year countdown to the FDA’s near prohibition of 99% of vapor products currently on the market. To prevent this, we have a specific ask of congress to update the 2007 predicate date to 2016. This is a necessary first step in a larger legislative battle to keep the diverse range of vapor products available.

As of August 8, 2016, the Food & Drug Administration (FDA) will consider vapor products to be “tobacco products” under the Family Smoking Prevention and Tobacco Control Act (the Tobacco Control Act). What does this mean for vaping and the development of new reduced harm products in the United States going forward?

On May 5, the U.S. Food and Drug Administration finalized a rule known as the Deeming Regulation, extending its authority under the Family Smoking Prevention and Tobacco Control Act, or Tobacco Act, to all tobacco products, including electronic cigarettes (e-cigarettes), also known as vapor products.
